Criminal Summary Appeal Form Information
Please find the criminal summary appeal form on the form page. You have 30 days from the date of the MDJ sentencing to file an appeal. The cost to file the appeal is $ 52.00 and is non-refundable. If the last day to file the appeal is on a weekend you have until the next business day to file the appeal.
Fill out the form and print firmly and clearly. The affiant section simply means the police agency that brought the charges against you. The issuing authority is the magisterial judge that heard your case.
If the Court of Common Pleas Judge finds you guilty or upholds the Magisterial Judge’s decision court costs will be assessed and collected by this office. If you elect to withdraw the appeal before the court of common pleas it means you are accepting the Magisterial Judge’s decision and court costs will be collected. If the Court of Common Pleas Judge finds you not guilty no additional costs are assessed and any money paid at the magistrate will be refunded to whoever paid the monies.
If you are appealing a motor vehicle conviction other than a parking violation, it is your responsibility to mail a copy of the form to the address listed at the bottom of the form to Penn. Dept. of Transportation, P.O. Box 60037, Harrisburg, PA 17106.
You will be provided this copy to mail once it is filed in this office and has a file stamp. This informs the department of transportation that you have filed an appeal so that points and or suspension is put on hold until after the hearing at the court of common pleas.
